1. Acceptance of Terms

1.1 These Terms of Service ("Terms") govern all use of the website www.softsins.net, the member dashboard at dashboard.softsins.net, and any products or services offered by Soft Sins GbR, Grindelhof 23, 20146 Hamburg, Germany ("Soft Sins," "we," "us," or "our").

1.2 By accessing our website, creating an account, or completing a purchase, you ("Customer," "User," "you") agree to be bound by these Terms in full. If you do not agree, do not use our services.

1.3 These Terms supersede any conflicting terms you may propose. No other terms will apply unless expressly agreed to in writing by Soft Sins.

2. Formation of Contract

2.1 Product listings on our website are invitations to purchase, not binding offers.

2.2 By clicking "Buy Now" or equivalent checkout button, you submit a binding purchase offer for personalized digital content.

2.3 A contract is formed when we send you an order confirmation by email.

2.4 A copy of your order details will be sent to the email address provided at checkout.

3. Products & Delivery

3.1 Soft Sins creates personalized, sensory audio experiences based on your inputs submitted during the customizer quiz.

3.2 Content is delivered exclusively via the member dashboard at dashboard.softsins.de through streaming access.

3.3 Access is granted following confirmed payment. Dashboard login credentials are sent by email.

3.4 Minimum technical requirements: active internet connection, valid email address, current web browser.

4. AI Chat Feature – Mandatory Disclosures ⚠️

Please read this section carefully before using the Chat Feature.

4.1 The Chat Feature is Fully AI-Generated — You Are Not Talking to a Human

The chat feature available at dashboard.softsins.de is operated entirely by artificial intelligence. No human reads or responds to your messages in real time.

We explicitly and unambiguously disclose the following:

• All chat characters are fictional, AI-generated personas with no real-world existence
• All responses are generated automatically by an AI language model
• AI systems are not sentient — they have no consciousness, genuine feelings, intentions, or opinions
• Any expressions of emotion, affection, memory, or personal experience by AI characters are simulated outputs, not real feelings
• Stored character "memories" are technical database entries, not the memories of a real person
• AI outputs may be inaccurate, inconsistent, or factually wrong ("hallucinations")

FTC Disclosure Notice: In accordance with FTC guidelines on deceptive practices and AI transparency requirements, we clearly disclose that all chat interactions on this platform are AI-generated. Failure to disclose AI-generated communication constitutes an unfair or deceptive practice under Section 5 of the FTC Act.

4.2 No Confusion with Real Persons

By using the Chat Feature, you expressly confirm that you understand:

• You are communicating with an AI, not a human being
• Chat characters do not represent real individuals
• Experiences that feel "human" or "real" are an intentional design feature — not evidence of human presence

4.3 No Professional, Medical, or Therapeutic Advice

The Chat Feature is for entertainment purposes only. It does not constitute:

• Psychotherapy or psychological counseling
• Medical advice or diagnosis
• Professional life or sex counseling
• Crisis intervention
• A substitute for human relationships, therapy, or professional support

4.4 Risk of Emotional Dependency — Explicit Warning

Research on AI companion services indicates that users can develop emotional attachments to AI characters that resemble real relationships in intensity. Soft Sins explicitly warns:

• Emotional dependency on AI characters is possible and should be actively avoided
• The Chat Feature is not designed as a permanent emotional substitute for human relationships
• Soft Sins is not liable for psychological or emotional harm resulting from excessive attachment to AI characters

If you feel your use of the Chat Feature is affecting your real-world relationships or daily life, we strongly encourage you to seek professional support.

4.5 Prohibited Uses

The following are strictly prohibited when using the Chat Feature:

• Generating or requesting content that sexualizes minors in any way
• Using the AI to plan or facilitate illegal activity
• Attempting to bypass AI safety mechanisms ("jailbreaking" or prompt injection)
• Using the system for automated scraping or data mining
• Attempting to identify or track real individuals

Violations will result in immediate account termination without refund.

4.6 Data Processing in the Chat Feature

4.6.1 Chat inputs are processed to generate AI responses and personalize audio content (legal basis: performance of contract / your explicit consent).

4.6.2 We strongly advise against entering sensitive personal information in the chat (health data, political views, data about third parties).

4.6.3 Conversation data is never sold or shared with third parties for advertising purposes. See our Privacy Policy for full details.

4.6.4 You may request deletion of your conversation data at any time by emailing info@softsins.de.

4.7 No Availability Guarantee

The Chat Feature is provided without any uptime or availability guarantee. We reserve the right to modify, restrict, or discontinue the Chat Feature at any time without notice or liability.

5. Pricing & Payment

5.1 All prices shown at checkout are final and inclusive of any applicable taxes.

5.2 Payment is accepted via credit card and other methods displayed at checkout.

5.3 Payment is charged immediately upon order completion.

5.4 Content access is granted following confirmed payment receipt.

5.5 All transactions are processed by our payment processor. Billing descriptors are discreet and do not reference the nature of the content on your bank or card statement.

6. Refund & Cancellation Policy

6.1 All Sales Are Final

All products are individually personalized digital content. Once dashboard access has been granted or a download link has been delivered, no refunds, returns, or exchanges are available.

6.2 Cancellation Window

Cancellations are only accepted before production begins — typically within minutes of ordering. Contact info@softsins.de immediately if you wish to cancel. Once production has started, cancellation is not possible.

6.3 Consent to Immediate Delivery

By completing your purchase, you explicitly consent to:

• Immediate commencement of personalized content production
• Delivery beginning before any applicable cancellation period expires
• Acknowledgment that this consent forfeits any right to a refund once access is granted

6.4 Quality Defects

If your content contains a verifiable technical defect or was delivered incompletely, contact us within 14 days at info@softsins.de. We will provide a free remake or replacement. This does not constitute a refund.

6.5 Chargeback Notice

You agree to contact us directly before disputing any charge with your bank or payment provider. We maintain complete production and delivery records. Fraudulent chargebacks may result in permanent account suspension and submission of documentation to your payment provider.

7. Intellectual Property & License

7.1 Upon purchase, you receive a limited, non-exclusive, non-transferable license for private personal use only.

7.2 The following are strictly prohibited:

• Redistribution or resale of any content
• Public performance or broadcast
• Commercial use in any form
• Unauthorized copying or reproduction

7.3 All content — including AI-generated chat outputs — is protected by applicable copyright and intellectual property law.

7.4 You may create one private backup copy for personal use.

8. Platform Availability

8.1 We strive for high uptime but do not guarantee 100% availability of any platform or feature.

8.2 Scheduled maintenance may cause temporary interruptions. We will provide advance notice where possible.

8.3 Your dashboard access is permanent and tied to your account, as long as your account remains in good standing.

9. Privacy & Personalization

9.1 We take the protection of your personal data seriously. See our full Privacy Policy for details.

9.2 Data submitted in the customizer quiz and chat feature is used solely to personalize your content and deliver our services.

9.3 We do not sell your personal data to third parties.

10. Age Verification & Adult Content

10.1 All content — including the Chat Feature — is intended exclusively for individuals 18 years of age or older.

10.2 By using our services, you explicitly confirm that you are at least 18 years old. Misrepresentation of age may result in immediate account termination and potential legal liability.

10.3 Sharing content with minors is strictly prohibited. We reserve the right to suspend accounts without refund upon reasonable suspicion of minor access.

10.4 Parents and guardians are responsible for ensuring minors do not access this platform.

11. Warranties & Remedies

11.1 We warrant that digital content will be delivered as described and technically functional.

11.2 In the event of a defective or incomplete delivery, your remedy is a free replacement or remake. We do not offer monetary refunds except where expressly required by applicable law.

11.3 For quality concerns, contact info@softsins.de within 14 days of delivery.

12. Limitation of Liability

12.1 Nothing in these Terms limits liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.

12.2 For all other claims, our total liability is limited to the amount you paid for the specific product giving rise to the claim.

12.3 AI Chat Disclaimer: Soft Sins is not liable for psychological, emotional, or other harm arising from use of the Chat Feature — including harm arising from users mistaking AI outputs for real human communication, or from developing emotional dependency on AI characters. Users are explicitly warned of these risks in Section 4 of these Terms.

12.4 We are not liable for indirect, incidental, consequential, or punitive damages, or for loss of profits, to the fullest extent permitted by applicable law.

13. Dispute Resolution

13.1 In the event of a dispute, please contact us first at info@softsins.de. We will make reasonable efforts to resolve issues informally.

13.2 These Terms and any disputes arising from them shall be governed by the laws of Germany, without regard to conflict of law principles, except where mandatory local consumer protection law applies.

13.3 For US customers, any unresolved dispute may be submitted to binding individual arbitration under standard commercial arbitration rules. Class action claims are expressly waived.

14. Changes to These Terms

14.1 We reserve the right to update these Terms at any time. Changes will not apply retroactively.

14.2 You will be notified of material changes by email at least 30 days before they take effect.

14.3 Continued use of our services after the effective date of changes constitutes acceptance of the revised Terms.

15. General Provisions

15.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.

15.2 These Terms constitute the entire agreement between you and Soft Sins regarding use of our services.

15.3 Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
